Welcome to Wann. These Terms of Service (“Terms”) constitute a legally binding agreement between you and Wann (“we”, “us”, or “our”). These Terms govern your access to and use of our mobile application (the “App”), website, and all related AI-powered creative services (collectively, the “Service”).

BY DOWNLOADING, INSTALLING, OR USING THE SERVICE, YOU AGREE TO BE BOUND BY THESE TERMS. IF YOU DO NOT AGREE TO THESE TERMS, DO NOT ACCESS OR USE THE SERVICE.

1. Eligibility and User Representation

l Minimum Age: The Service is strictly intended for individuals aged 18 years or older. You represent and warrant that you meet this age requirement.

l Capacity: You represent that you have the legal capacity to form a binding contract and are not prohibited from receiving the Service under applicable laws.

2. License Grant and Usage Restrictions

l Limited License: Subject to your strict compliance with these Terms, Wann grants you a limited, non-exclusive, non-transferable, non-sublicensable, and revocable license to use the Service for personal, non-commercial purposes.

l Prohibited Conduct: You shall not:

¡ Decompile, reverse engineer, or attempt to extract the source code of the App.

¡ Circumvent or disable any security features or Digital Rights Management (DRM).

¡ Use automated systems (bots, scrapers) to access or harvest data from the Service.

3. User-Generated Content (UGC) & AI Functionality

The Service utilizes artificial intelligence to process input (e.g., text, images, video) and generate outputs.

l Ownership: You retain ownership of your inputs and the resulting AI outputs.

l License to Wann: By using the Service, you grant Wann a worldwide, royalty-free, and limited license to process, host, and transmit your content solely to provide the requested AI results. We will not use your private content for model training without your separate, explicit opt-in.

l Third-Party Rights: You represent that you own or have obtained all necessary permissions/licenses for any content you upload, including the explicit consent of any individuals whose likeness appears in your media (e.g., for face-swapping features).

4. Generative AI Safety and Conduct Policy

In compliance with global safety standards for AI platforms, you are strictly prohibited from using the Service to generate or distribute:

l Explicit Material: Pornography, sexually suggestive content, or graphic sexual imagery.

l Non-Consensual Representations (Deepfakes): AI-generated depictions of real individuals without their express consent.

l Harmful Content: Imagery depicting extreme violence, promoting self-harm, or inciting hate speech/harassment against protected groups.

l Deceptive Content: Disinformation, malware, or content intended to defraud others.

Enforcement: Wann reserves the right to monitor content, utilize safety filters, and permanently terminate accounts for severe or repeat violations without notice.

5. Intellectual Property Rights

All rights, titles, and interests in the Service (excluding your UGC)—including but not limited to the App’s interface, AI algorithms, software, and trademarks—are the exclusive property of Wann or its licensors. Unauthorized use is strictly prohibited.

6. Subscriptions and In-App Purchases (IAP)

l Billing: All financial transactions are managed securely by Apple Inc. (iTunes Account).

l Automatic Renewal: Subscriptions automatically renew at the same price and duration as the original package unless auto-renew is turned off at least 24 hours before the end of the current period.

l Cancellation: You may manage or cancel your subscription at any time via your Apple ID Account Settings.

l Refunds: All refund requests are handled exclusively by Apple. Wann is not authorized to process refunds directly.

7. Disclaimer of Warranties

THE SERVICE IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS. WANN DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING THE WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. WE DO NOT GUARANTEE THAT THE AI-GENERATED OUTPUTS WILL BE ACCURATE, UNINTERRUPTED, OR FREE FROM ERRORS.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WANN SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, OR CONSEQUENTIAL DAMAGES ARISING FROM YOUR USE OF THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

9. Termination

l By You: You may terminate these Terms by uninstalling the App and ceasing all use.

l By Us: We may suspend or terminate your access for any breach of these Terms or to comply with legal requirements.
